Islamabad: The High Court has dismissed the case against the Afghan woman who came without a visa, saying that the constitution gives the right to political asylum.
Dismissing the case filed against the Afghan woman for not having a Pakistani visa, the Islamabad High Court remarked that the Constitution of Pakistan recognizes the right to asylum.
Justice Babar Sattar issued a detailed judgment on the petition filed against Raheel Azizi, an Afghan woman who came to Pakistan without a visa under the Foreigners Act, in which the court ordered the Home Secretary to issue a permit to the woman to travel to Australia. . The court also dismissed the case filed against the woman who was in jail for 9 months.
In a detailed decision, the court said that asylum seekers cannot be sent to jail. After the Taliban took over, Raheel Azizi’s life was threatened in Afghanistan. The woman came to Pakistan to save her life. On this basis, the Australian government has given a visa to the Afghan woman.
In the verdict, it has been said that the Afghan woman was not found in Australia due to the case filed in Pakistan. In this situation, a case cannot be prosecuted against Raheel Azizi under the Foreigners Act. The Home Secretary will issue a permit to the woman to travel to Australia.
It should be noted that the FIA had registered a case under Section 14 of the Foreigners Act against the woman coming from Afghanistan.
