The order dissolving the Assembly should be declared illegal, petitioner
Peshawar: A writ petition has been filed in the Peshawar High Court to restore the Khyber Pakhtunkhwa Assembly and the court has been requested to annul the order to dissolve the assembly.
The application has been filed on behalf of Muhammad Furqan Qazi through the mediation of Saifullah Mohib Kakakhil Advocate.
It has been argued in the writ that the act of dissolving the KP Assembly was illegal as Chief Minister Khyber Pakhtunkhwa Mehmood Khan sent the summary of dissolution of the assembly to the Governor Khyber Pakhtunkhwa without thinking.
It has also been stated in the petition that the chief minister has dissolved the assembly on the request of the party chief Imran Khan and now the PTI chief has also admitted that someone else had advised him to dissolve the assembly. On his request, he had directed to dissolve the assembly of KP and Punjab
It has been said in the petition that the Lahore High Court has also invalidated the resignations of the members of the National Assembly of Tehreek-e-Insaf, so the court should declare the order of dissolution of the Khyber Pakhtunkhwa Assembly as illegal because in this process the Chief Minister violated the Constitution and the law. did not put forward and advised the governor to dissolve the assembly, while the governor also accepted the suggestion without thinking and dissolved the assembly.
He has requested in the writ petition that the order to dissolve the assembly should be declared illegal and orders should be issued to elect the chief minister and the cabinet to the party which is in the majority.
