PTI can exercise its legal right to campaign, Peshawar High Court

A political party cannot be deprived of its rights, High Court ruled

Peshawar High Court has issued a written decision on the petition filed for election campaign and rallies of Pakistan Tehreek-e-Insaaf.

The court said in the judgment that the petitioner took the stand that the election preparations are going on but they are not being allowed to campaign and the media coverage of the party is also banned.

The High Court said in the judgment that the petitioner took the position that he had applied to the district administration several times for the convention but they were rejected. The General raised an objection to the admissibility of the petitions.

In the written decision, it was said that we asked the Advocate General whether there is any ban on PTI, whether declared or not, to which the Advocate General said that there is no such ban on PTI, as per the Khyber Pakhtunkhwa Civil Administration Act, 2020. According to section 14, prior permission from the administration is mandatory for organizing meetings and conventions.

According to the court, the petitioner said that we have an agreement with the Advocate General that we will take permission first, the Advocate General assured that the district administration will also perform its legal duty.

The Peshawar High Court said in the judgment that PTI is allowed to hold meetings under the law and can exercise its legal right to conduct election campaigns, no political party can be deprived of its right, the petitioners are allowed to hold their elections. Campaigning is allowed, caretaker government takes steps to conduct transparent elections.
