Islamabad: The Supreme Court has said that there should be a heavy penalty for false cases so that anyone would think 10 times before applying.

A case was heard in the Supreme Court against the involvement of citizens in unnecessary and false cases. The court ordered the petitioner to pay a fine of Rs.

The Supreme Court remarked that false cases put an artificial burden on the courts and genuine victims are affected. False cases should be heavily penalized so that the applicant will have to think 10 times. False and frivolous litigation is an unlawful use of judicial process.

The Supreme Court further said that a citizen named Qazi Mubasher filed an inheritance claim to withdraw 32,000 from the account of his late father. Cousin Qazi Naveed challenged the claim of inheritance due to a property dispute that did not include the names of the sisters. The sisters appeared in the court and stated that we took 32,000, but the case continued.

The court said that for 13 years the cases were pending on the plea of fraud due to personal grudges. Petitioner’s pleas were rejected by the trial, sessions and High Court. ADR system needs to be activated to resolve minor disputes. By wasting the valuable time of the courts on unnecessary disputes, the rights of the original rights holders are lost.
