Notice to Election Commission on appeal against rejection of Imran Khan's papers

Lahore: The court issued a notice to the Election Commission on the appeal against the rejection of Imran Khan’s nomination papers.

A three-member bench headed by Justice Ali Baqir Najafi of Lahore High Court heard the appeal against the rejection of the nomination papers of PTI founder chairman, in which Aziz Bhandari advocate appeared on behalf of Imran Khan.

The lawyer told the court that the founding chairman of PTI has submitted papers for election from National Assembly Constituency NA 122 Lahore and 89 Mianwali. Tosha Khana’s allegation in rejecting the nomination papers submitted in both the places is the same. In NA 122, the supporter was alleged not to be from the constituency. According to the law, nomination papers can be rejected on penalty of 2 years.

Arguing in the court, the lawyer further said that there is no charge in NA 89 except Tosha Khana punishment. Punishment in Tosha Khana was given on the basis of moral turpitude. There is no interpretation of moral turpitude in judicial decisions.

The court inquired from the lawyer Election Commission whether the petitioner was sentenced for moral turpitude. How much punishment was given, to which the Election Commission’s lawyer replied that he will assist the court on this matter. Petitioner has 2 convictions.

Founder Chairman PTI’s lawyer said that the Returning Officer (RO) and the Appellate Tribunal have relied on the arguments of Toshakhana’s conviction.

Later, the court issued a notice to the Election Commission for rejecting the nomination papers of Imran Khan.
