The Lahore High Court issued a written decision to make public the records of Tosha Khana from 1990 to 2001.
Justice Asim Hafeez, in a written decision issued on the request of citizen Munir Ahmed, wrote that the government should make public the records of Tosha Khana within 7 days of the certified copy of the court order. The government should also make public the names of those who gave gifts from 1990 to 23 March 2023.
The decision further states that the ownership of the gifts rests with the government. These are held by the government until a procedure is adopted to take them. The judgment held that concealment of gifts or non-payment of their value is an offense which invites malpractice, and those who have received gifts are expected to declare them voluntarily.
The decision of the Lahore High Court has ordered that criminal action can be taken against those who do not disclose gifts, no one is above the law and no one is allowed to harm the state for their own benefit.
The court further clarified that the identity of the donor is neither a state secret nor sacred information. Asking for exemption is nothing but colonial mentality. According to the decision, sharing the Tosha Khana information with the public will not harm Pakistan’s international relations.
