Islamabad: The High Court has called for the record of the decision to keep Imran Khan in jail despite the suspension of the sentence in the hearing of the case related to the transfer of Chairman PTI to Attock Jail.
Chief Justice Islamabad High Court Justice Aamir Farooq heard PTI Chairman and former Prime Minister Imran Khan’s request regarding facilities in jail, in which Assistant Superintendent Hasrat from Attock Jail appeared in the court. The court ordered that after the suspension of the sentence of Chairman PTT, if any notification has been issued to keep him in Attock Jail, he should be informed.
The lawyer of Chairman PTI told the court that it is said that he was transferred to Attock Jail due to lack of space. Chairman PTI was transferred to Attock Jail just to cause more pain. Security arrangements are better in Adiala Jail, B Class is also there. We have the right to be transferred to Adiala jail and provided with B class. When Bushra Bibi went to meet her in jail, they tried to file a case against her as well. It was alleged that Bushra Bibi tried to bribe the jail official with 20 thousand rupees.
During the hearing, the prosecutor told the court that what our dear friend has said is not true. The B class has now been abolished in the jail, only ordinary and better classes exist. Chairman PTI has been provided better class. The walls of the bathroom have been raised and a commode has been installed. A 21 inch TV has also been installed. 5 Newspapers are also provided to Chairman PTI in Jail. The facilities that they want to get in Adiala Jail, we are also providing them in Attock.
The Assistant Advocate General told the court that bed, chair, 21 inch TV and 5 newspapers have been provided to Chairman PTI. Chairman PTI is also given food at his will. 5 doctors have been appointed for Chairman PTI. They are cooked in chicken and mutton desi ghee for 2 days.
The Chief Justice remarked that you have told all these things but the main objection of the petitioner is something else. When the trial court asked to keep him in Adiala Jail, why was he transferred to Attock Jail? Did Adiala Jail Superintendent request PTI Chairman to be kept in Attock Jail?
The Assistant Advocate General told the court that the IG has the authority to transfer any prisoner from one jail to another, to which the Chief Justice said that if Islamabad does not have its own jail, the prisoners are kept in Adiala Jail. . Lawyer Sher Afzal said that when this petition was filed, Chairman PTI had been punished. Chairman PTI’s sentence has now been suspended and bail has been granted. Chairman PTI’s detention status has now changed.
Chief Justice Amir Farooq said that it is true that PTI chairman is not serving the sentence at present. Chairman PTI is in custody in another under-trial case. Within Islamabad, trial prisoners are kept in Adiala Jail. If the coat is taken from Attock to Lakhpat, can it be brought to every appearance? It is a 5-6 hour journey from Kot Lakhpat. How much is the journey from Attock Jail to Islamabad?
The Assistant Advocate General said that it is an hour and a half journey from Attock to Islamabad, on which the Chief Justice said that the vehicle in which they bring it would take 10, 15 minutes more. Was there any decision to keep Chairman PTI in Attock Jail after the sentence was suspended?
The Assistant Advocate General replied that I can give instructions in this regard.
The Chief Justice remarked that still all our undertrial prisoners are brought from Adiala Jail. I will issue an order on this request. He is an under-trial accused in the cipher case. Can the prison be changed during the trial? The trial is to be held in Islamabad.
The Islamabad High Court adjourned the hearing on the request of Imran Khan for jail facilities and jail transfer, directing lawyer Sher Afzal Marwat to meet Chairman PTI on Thursday. The court ordered that after the suspension of the sentence of Chairman PTT, if any notification has been issued to keep him in Attock Jail, let him know. Later, the hearing was adjourned till September 11.
