An interesting dialogue took place between the Chief Justice and the lawyers in the Islamabad High Court on the plea of Pakistan Tehreek-e-Insaf (PTI) chairman in the Tosha Khana case for suspension of sentence.
The lawyer of the Election Commission said that the status of the accused was changed to criminal after the conviction, the convict is now in the prison of the state, the state should be heard by notice, the state has the right to defend the decision.
Chief Justice Amir Farooq remarked that do you think the state will come and say that the punishment was given wrongly? It is a short sentence and can be suspended without notice.
On this, Amjad Parvez said that there is no decision to suspend the sentence without notice, the sentence of three years imprisonment is being called a sentence of short duration, Captain Safdar was sentenced to only one year of imprisonment. It took 3 months for the High Court to suspend the sentence.
In the Islamabad High Court, the hearing on PTI Chairman’s request for suspension of sentence was adjourned till tomorrow.
Chairman PTI’s lawyer Latif Khosa told the Chief Justice that the trial court ignored your decision, sorry you also did not stop the trial court from final decision.
