Lahore: The High Court stopped the Election Commission from taking a final decision on the contempt of commission case against Chairman PTI Imran Khan.
A hearing was held in the Election Commission on the petition of the former prime minister against the ongoing contempt of commission proceedings, in which the court stopped the Election Commission from making a final decision on the contempt of election case against Imran Khan.
The court said that the Election Commission should continue its proceedings but not take a final decision. The court issued notices to the Election Commission and others on the next hearing and directed them to present the petition before the full bench.
The application was heard by Justice Waheed Khan of Lahore High Court while Barrister Samir Khosa appeared in the court on behalf of Chairman PTI. The court has written in its note that other similar applications are being heard by the full bench. Therefore, this matter should also be placed before the full bench.
It should be noted that Chairman PTI has challenged the Election Commission’s June 20 order, in which it has been held that under Clause 10 of the Election Act 2017, the Election Commission is also guilty of contempt of court like the High Court and the Supreme Court. using options. Section 10 of the Election Act is a violation of the Constitution and the law.
It was argued in the petition that the power of contempt of court is with the Supreme Court and the High Courts. The proceedings of contempt of Election Commission are outside the jurisdiction of Election Commission. The court should annul the proceedings of contempt of Election Commission against Chairman PTI and declare Section 10 of the Election Act as unconstitutional.
