The Islamabad High Court annulled the trial court’s decision to reject the PTI chairman’s petition in the Toshakhana case.
The Chief Justice of the High Court Aafir Farooq accepted the petition against the decision of the Sessions Court.
The Islamabad High Court referred the matter back to the trial court and ordered the trial court to decide again on the arguments of the PTI chairman’s counsel.
The court declared that the trial court should decide on the request of Chairman PTI in the Tosha Khana case within 7 days.
Lawyer Gohar Ali Khan, giving arguments during the hearing, said that the complaint was filed by the wrong person in the Tosha Khana case, the case ended with the Sessions Judge.
The trial court rejected the plea to declare the Tosha Khana case inadmissible and declared the case admissible and indicted Chairman PTI.
Chairman PTI expressed no confidence in Chief Justice Amir Farooq
Before the decision of the High Court, Chairman PTI had expressed no confidence in Chief Justice Islamabad High Court Aamir Farooq in the Tosha Khana case.
The PTI chairman had filed a petition to transfer the petitions against the Tosha Khana case trial to another bench, in which the District Election Commission was made a party.
In the petition, the Chief Justice was requested to excuse himself from hearing the petitions of the Chairman Pakistan Tehreek-e-Insaaf.
In the petition filed, it was said that Chairman PTI is convinced that transparent and impartial justice will not be provided by this bench.
It should be noted that the appeals of Chairman PTI against the decision of the Sessions Court are being heard in the court of Chief Justice Islamabad High Court.
