Notices were issued to Election Commission and Advocate General for June 13. Justice Yusuf Ali Saeed remarked that your case is in the nature of urgent hearing, understandably.
In the petition filed in the court, it was held that the initial local government elections were completed under the Local Government Act 2013. Under the same law, the elected chairman/mayor candidates took oath. Under the amendment act, unelected persons have been allowed to be appointed as chairman/mayor. According to the spirit of the Local Government Act, the Mayor should be one of the elected representatives.
The petition states that Articles 90 to 93 and 129 to 131 of the Constitution clarify the structure of federal and provincial governments. Electing unelected persons as Mayor/Chairman would be against the spirit of the Constitution and Local Government Acts. The notification dated 24th May issued under the recent amendment should be declared illegal.
