Request to dismiss applications against the Practice and Procedure Act of Q-League

The Pakistan Muslim League-Q requested the Supreme Court of Pakistan to dismiss the petitions against the Supreme Court Practice and Procedure Act.

In the case of petitions against the Supreme Court Practice and Procedure Act, Muslim League-Q has submitted a reply in the Supreme Court, in which the petitions have also been requested to be dismissed.

In the submitted reply, Muslim League-Q is of the opinion that the Act will not reduce the independence of the judiciary, the opportunity for reforms was missed after the lawyers’ movement in the country.

In the reply submitted by Muslim League-Q, it has been contended that Section 4 of the Act widens the jurisdiction of the Supreme Court, Section 3 of the Act does not curtail the exercise of the Judiciary’s 184(3) power.

The reply submitted states that Section 3 calls for exercise of the Chief Justice’s ex officio notice power in conjunction with senior judges.

In the reply submitted by the QLG to the Supreme Court, it has been said that the use of the powers of self-notice and appointment of cases by the committee will increase public confidence.

In response, the Q-League says that former Chief Justices Iftikhar Chaudhry, Saqib Nisar and Gulzar Ahmed used their powers proactively, the results of which came in the form of Steel Mill, PKLI and Nasla Tower.

The Muslim League-Q in its reply submitted to the Supreme Court has taken the stand that legislation like the Practice and Procedure Act could have avoided such consequences.

In the reply submitted to the Supreme Court, Muslim League-Q also says that independent judiciary means the performance of duties of every judge without restriction, pressure and interference.
