Muftis declared it illegal to buy things at a low price from Tosha Khana

Lahore: The muftis of Darul Uloom Jamia Naimiyyah have issued a fatwa to declare the law of Tosha Khana illegal, in which it has been said that It is not permissible to buy items at a lower price from the Tosha Khana because these gifts are the trust of the country and the nation and are not the personal property of anyone.

Among those who issued Sharia Fatwa are Nazeem-e-Ala Jamia Naimiya and member of the Islamic Ideological Council Allama Dr. Katram Mufti Raghib Hussain Naimi, Shaykh Fiqh Mufti Muhammad Imran Hanafi, Mufti Muhammad Nadeem Qamar, Mufti Muhammad Arif Hussain, Mufti Faisal Nadeem Shazli.

The muftis of Darul Uloom Jamia Naimiyyah have said in a fatwa that it is not permissible to buy items at a price lower than the Tosha Khana in terms of Shariah. The gifts, whether big or small, will be the property of the state and will be collected in the treasury of the state.

Muftis have said that it is not permissible for government officials to keep gifts in their possession or to take them for twenty percent or fifty percent of their value. It is illegal and haram and can be apprehended, the gifts of Tosha Khana are the trust of the country and the nation, they should be spent on public welfare.

It is stated in the fatwa that according to the blessed hadiths, gifts received by government officials will be collected in the treasury of the state, 20 percent or 50 percent of the gifts received by heads of state, ministers and other government officials from foreign visits. The country’s law of buying on hundred money is not correct in Shariah.

Ulama said that if the chiefs and officials want to bring these gifts in their possession, they can bring them only after paying the full price according to their market value, the better solution is to auction these gifts and in the auction. Every public and private should be allowed to participate, the proceeds of this auction should be deposited in the national treasury as these gifts are the property of the state.
