A party that does not win a single seat in an election is not eligible for certain seats, Peshawar High Court

Peshawar: The High Court has declared in the detailed decision of the case related to reserved seats that the party which does not win a single seat in the election is not eligible for reserved seats.

The Peshawar High Court has issued a detailed decision in the case of the petition related to the allotment of specific seats by the Sunni Ittehad Council. The 30-page judgment was written by Justice SM Atiq Shah while the brief judgment was delivered by a 5-member larger bench of the Peshawar High Court on March 14.

The court has said in its detailed decision that the Peshawar High Court has the authority to hear cases of specific seats up to the province. The Election Commission’s decision to distribute certain seats to other political parties is in accordance with Article 51 of the Constitution. The Sunni Union Council is not entitled to a reserved seat for women.

The court further said in its judgment that the list of specific seats cannot be submitted after the prescribed time. An objection was raised on behalf of the petitioner that these reserved seats cannot be distributed among other political parties. Sunni Ittehad Council is not entitled to reserved seats, hence the application is rejected.

The Peshawar High Court declared that a political party which does not win a single seat in the general election is not eligible for certain seats. The right to certain seats belongs to the political party participating in the general election. Peshawar: In the constitution, the seats in the provincial and national assembly will not be left vacant.

According to the detailed judgment, PTI’s argument that reserved seats cannot be given to other parties is unconstitutional. The Election Commission has distributed the specific seats in a constitutional manner. The Sunni Ittehad Council had not previously submitted lists for specific seats. Sunni Ittehad Council is not eligible for certain seats due to non-submission of list for seats in time.
