The Election Commission should remove the concerns of the petitioners against the election results, Peshawar High Court

Peshawar: The High Court has ordered that the Election Commission remove the objections of the petitioners against the election results.

The Peshawar High Court has issued a written decision to hear the petitions of PTI-backed candidates against the results of the general elections to be held in the country.

The 3-page judgment was penned by Justice Shakeel Ahmed, in which the court asked the RO to give the petitioners an opportunity to compile the results as per Section 95 of the Election Act, 2017. After the ROs have compiled the results, then the applicant should approach the appropriate forum (Election Commission).

The written decision said that the Election Commission should look into the concerns of the petitioners as per the law. The contentions of the petitioners are similar that there is a discrepancy in Forms 45 and 47. The petitioners also complain that there has been a flagrant violation of Sections 92 and 95 of the Election Act while compiling the results.

The High Court in its judgment further said that if the election results were compiled in front of the polling agents or in their absence, there is a discrepancy in Forms 45 and 47 if the Election Commission looks into it. The Election Commission should scrutinize the Forms 45 and 47 with the applicants and the Forms 45 and 47 with the Election Commission.

In the court decision, it has been ordered that the Election Commission should give an opportunity to the parties and hear them as per the law. The Election Commission should decide on it again according to the constitution and law. The Election Commission should decide on these applications before the official gazette notification is issued.
