Determination of prices of sugar and commodities is only with the Provincial Government, Lahore High Court

The Lahore High Court gave a reserved decision on the petition filed by the sugar mill owners regarding the sugar prices.

A two-judge bench headed by Justice Shahid Karim delivered a 27-page judgment on the petitions and allowed the appeals of the sugar mill owners.

The court, in its written decision on the petitions of the sugar mills, said that only the provincial government has the power to fix the prices of sugar, the provincial government can better fix the prices of sugar and food items.

The court decision said that the federal government does not have the authority to set the prices of food items, a province can also trade goods with other provinces, provinces can make better decisions in the circumstances.

The written judgment said that the Act of 1977 was not in accordance with the Constitution of Pakistan and the provinces could not adopt the Act of 1977. Legislation related to price control was the power of the Provincial Assembly.

The Lahore High Court further wrote in the judgment that whether the Act of 1977 applies within the limits of Islamabad or not, it cannot decide as that matter was not raised before us.

The written judgment further states that the court allows the petitions and intra-court appeals.
