Punjab Local Government Act 2022 Challenged in Lahore High Court

Lahore: The Punjab Local Government Act 2022 was challenged in the High Court.

Justice Shams Mahmood Mirza heard the application of former Mayor Lahore Colonel (R) Mubasher Javed, in which the Punjab Local Government Act 2022 has been challenged. The court issued notice to the Chief Secretary, Local Government Secretary and other parties for next week. Besides, the court recommended to send the case to another bench and sent the file to the Chief Justice.

On the occasion of the hearing, former mayor Colonel (retd) Mubasher Javed appeared in the court along with his lawyer. The petitioner made the Caretaker Chief Minister through the Principal Secretary, Chief Secretary, Election Commission and others as parties and took the stand that the petitioner is the former Mayor of Lahore. The Local Government Act 2022 was introduced in the PTI government. Many provisions of the Local Government Act 2022 are not compatible with the parliamentary system.

In the application, it was said that in the Local Government Act 2022, the powers of the newly elected officials are less, while the powers of government officials are more. The Local Government Act 2022 is in conflict with Article 140A of the Constitution. The Local Government Act 2022 is in conflict with other provisions including Article 17, 32 of the Constitution.

The court was requested to declare the Punjab Local Government Act 2022 null and void and suspend the notification of the Local Government Act 2022 till the final decision of the case. The court should order the Election Commission to conduct the elections according to the Local Government Act 2013.
