Order to complete the identification of the suspects involved in May 9 incidents within 48 hours

Lahore: The High Court passed a major decision on the delay in the identification parade of the accused involved in the May 9 incidents and ordered that the identification of the accused should be completed within 48 hours.

Justice Tariq Saleem Shaikh issued a 13-page decision on the request of citizen Muhammad Ramadan while ordering the Session Judges and Special Courts across the province to complete the identification parade process in 48 laps. Send all sessions judges and IG Punjab.

The court judgment further stated that the process of identification parade was delayed, thereby curtailing the freedom of citizens. Every human being has the right to live with dignity, freedom and security. International human rights laws also speak of civil liberties. The court said in the judgment that people cannot differentiate between arrest before punishment and arrest after punishment. Arrest of a person should be based on solid evidence and only when there is no other option. International human rights groups have also expressed serious reservations about pre-trial arrest. Declaration of innocence of an arrested suspect before trial is a painful aspect of arrest. Arrest before trial for an innocent person is nothing less than a trauma mockery.

In the judgment, the court wrote that the process of identification parade is very important for any accused. The current process of identification parade is very inefficient, delay in this process makes the whole process suspicious. Delay in the process of identification parade is a violation of fundamental rights, dignity and fair trial. Constitutional Courts are responsible for protecting the Constitution. Constitutional courts are required to review the actions of the administration.

The judgment said that the petitioner has been in jail since May 25 for identification parade. Delay in identity parade is a violation of fundamental rights. On May 9, workers ransacked, damaged government and private property. To control the situation, the Deputy Commissioner issued orders to detain the citizens. When the detention orders were suspended, people were named in the cases and arrested. After the arrest, the accused were presented to the court for identification parade.
