The Islamabad court has reserved its decision on the request for physical remand of Lieutenant General (retd) Amjad Shoaib, who was arrested yesterday in the case of inciting people against institutions and spreading hatred.
Amjad Shoaib was produced in the District and Sessions Court Islamabad.
Investigation officer of Ramna police station, prosecutor and legal team of Amjad Shoaib also appeared in the court of Judicial Magistrate Abbas Shah.
While requesting the physical remand of Amjad Shoaib from the court for 7 days on behalf of the prosecution, it was told that the photogrammetric test of Lt. General Retired Amjad Shoaib is to be done from Lahore.
The accused can be punished for 5 and 7 years
In the court, Prosecutor Adnan read the text of the case against Amjad Shoaib and told the court that Amjad Shoaib was present as a guest on private television, his statement spread hatred against the government, the statement between the government, opposition and government employees. An attempt was made to spread hatred, the opposition was incited to take a tougher strategy against the government, Amjad Shoaib’s statement spread hatred between 3 groups, they can be punished for 5 and 7 years under the provisions.
Mudassar Khalid Abbasi, Amjad Shoaib’s lawyer, opposed the physical remand of his client and requested to discharge him from the case.
The lawyer argued that the court has to see whether Amjad Shoaib has committed any crime or not, if the magistrate feels that he has not committed any crime, then he can be discharged from the case. Provisions are not made, Amjad Shoaib only gave an example related to a specific situation, what has he said that is prohibited by law? He has never done anything that will harm the country, Amjad Shoaib has been prosecuted only on political grounds, he is almost 80 years old, he has given positive criticism, he has been harassed for a long time. Yes, Amjad Shoaib was sent behind bars after registering a case within an hour. If it is wrong to criticize legitimately, then remove the opposition from the system.
Arguments of President Islamabad District Bar
Along with this, the arguments of Amjad Shoaib’s lawyer were completed after which President Islamabad District Bar Association Qaiser Imam gave arguments on behalf of the accused and said that Amjad Shoaib is admitting his statement that he was sitting on television. If the statements were made and their presence was acknowledged, why should photogrammetric and voice matching tests be conducted?
The prosecutor said that the evidence of voice matching and photogrammetric test is essential for the trial.
Opposition to Discharge of Prosecutor
The prosecutor opposed the request to discharge Amjad Shoaib from the case.
The defense lawyer argued that the arrest of the officers of 2 institutions was left, the next arrest may be of an officer of the judiciary.
Amjad Shoaib’s lawyer State Ali Azad argued that Amjad Shoaib fought the wars of 1965 and 1971, he is the most patriotic citizen of Pakistan, he did not tell the citizens not to go to government offices.
On this occasion, the three lawyers of Amjad Shoaib requested the court to discharge the case.
Amjad Shoaib’s lawyers were overwhelmed

Case filed against Amjad Shoaib
The case against Lt. Gen. (Rtd) Amjad Shoaib was registered in Ramna Police Station under the charge of Magistrate Awais Khan.
Sections 153A and 505 have been added to the Act.
The text of the case states that in the TV program, Amjad Shoaib incited the people to revolt, the statement incited to prevent civil servants and the opposition from performing official legal duties.
According to the registered case, an attempt was made to create anxiety, insecurity and chaos in the country by his statement, and an attempt was made to spread enmity, incitement and hatred in the government and the opposition.
It has also been stated in the registered case that Amjad Shoaib has also conspired to weaken the country by creating hatred among the government, opposition and civil servants.
