The authority of the Election Commission to withdraw election symbols from political parties is declared valid

Lahore: The High Court upheld the authority of the Election Commission to withdraw election symbols from political parties.

Justice Shahid Bilal Hasan issued a written decision dismissing the petition against the authority to withdraw election symbols from political parties. In an 18-page judgment, the court declared that Section 215 of the Election Act, 2017 is not inconsistent with the Constitution.

It has been said in the court decision that this section does not conflict with the Constitution in the light of other articles including Article 17,9,14. It was included in the Election Act 2017 to empower the Election Commission. The application is not admissible.

The Lahore High Court declared that political parties should abide by the Constitution and the Act. The law regarding intra-party elections is contained in section 209 and 210 of the Election Act, 2017. According to the petitioner, the power to withdraw election symbols from political parties is against the constitution. The petitioner prayed for repeal of Section 215 of the Election Act, 2017.

It should be noted that an application was filed in the Lahore High Court against the authority of the Election Commission to withdraw election symbols from political parties on behalf of citizen Mian Shabbir Ismail.
