Islamabad: Justice Mazahir Naqvi approached the Supreme Court challenging the action of the Supreme Judicial Council in the audio leak scandal.
Supreme Court judge Justice Mazahir Naqvi has requested the Supreme Court to end the proceedings of the Supreme Judicial Council and to declare the notice received by the Supreme Judicial Council illegal.
Justice Mazahar Naqvi, through advocate Makhdoom Ali Khan, filed a constitutional petition in the Supreme Court, challenging the action of the Supreme Judicial Council. It has been argued in the petition that in the twenty-first constitutional amendment case, the Supreme Court has declared the independence of the judiciary as a part of the basic constitutional structure.

It has been stated in the petition that since February 16, I have been facing a derogatory campaign. A media trial is going on against me. Complainants against me are attacking the judiciary. In the Justice Qazi Faiz Isa presidential reference case, the principle was laid down that the judge should have the right to a transparent trial. The Supreme Judicial Council’s issuance of a show-cause notice to me is a violation of fundamental human rights.
Justice Mazahir Naqvi’s application further stated that the press release issued about the show cause notice was issued without taking my opinion. I had a media trial by issuing a press release of the Supreme Judicial Council. The proceedings of the Supreme Judicial Council against me should be annulled as malicious. The show-cause notice issued by the Judicial Council should be declared against the law.
It should be noted that the 3-member committee will decide whether or not to schedule the petition filed under Clause 3 of Article 184 for hearing in the open court. Under the Practice and Procedure Act, the 3-member committee is chaired by Chief Justice of Pakistan Qazi Faiz Isa. The other 2 members of the committee include Justice Sardar Tariq Masood and Justice Ejaz Ul Ahsan.

The meeting chaired by Chairman Supreme Judicial Council Justice Qazi Faiz Isa will be held today, in which the written reply of Justice Mazahir Naqvi will be reviewed. The council has summoned the complainants against Justice Mazahir Naqvi in personal capacity.
10 complaints against Justice Mazahar Naqvi are under consideration in the Judicial Council, in which allegations of alleged financial irregularities have been made against Justice Mazahar Naqvi, on which the Supreme Judicial Council has issued a show cause notice to Justice Mazahar Naqvi.
Meanwhile, Justice Mazahir Naqvi has raised objections against 3 members of the Supreme Judicial Council in his written reply. In today’s meeting, the complaint against Justice Sardar Tariq Masood will also be considered. The Supreme Judicial Council has also summoned the complainant against Justice Sardar Tariq Masood.
