Islamabad: In the Tosha Khana gift investigation case, the Islamabad High Court declared the two NAB call-up notices sent to Imran Khan and Bushra Bibi as illegal and told the NAB that it can send a new notice after fulfilling all the legal requirements.
Islamabad High Court Chief Justice Aamir Farooq and Justice Babar Sattar issued a seven-page detailed decision on the petition of Imran Khan and Bushra Bibi against two NAB notices.
The court has said in the judgment that according to the NAB amendment, NAB has to state in the notice that he is summoned as an accused or as a witness. This amendment shows that it was made to meet the requirements of Article 10-A fair trial. While sending notices to Imran Khan and Bushra Bibi, Section 19E of the NAB amendment was not fully implemented.
It has been said in the order that the NAB call-up notices sent to Imran Khan and Bushra Bibi did not mention whether they are being called as accused or in any other capacity. NAB call-up notices are also inconsistent with the rules laid down by court decisions.
The court ruled against the 2 call-up notices of NAB and declared that NAB can send new notices by fulfilling all the legal requirements and the notices sent by NAB on March 16 and February 17 by Imran Khan and Bushra Bibi were challenged. had done
