Islamabad: A reference was filed in the Supreme Court against 8 judges of the Supreme Court including the Chief Justice of the Supreme Court Umar Atta Bandial.

In the reference filed by Mian Dawood Advocate in the Supreme Judicial Council, Chief Justice Umar Atta Bandial, Justice Ijazul Ahsan, Justice Muneeb Akhtar, Justice Mazahir Naqvi, Justice Muhammad Ali Mazhar, Justice Ayesha A. Malik, Justice Hasan Azhar Rizvi and Justice Shahid Waheed. A party has been made.

In the reference, based on Article 209 of the Constitution and Sections 3 to 6 and 9 of the Judges’ Code of Conduct, the position has been taken that Chief Justice Umar Atta Bandial exceeded his authority by appointing the bill approved by the Parliament for hearing. The Chief Justice unconstitutionally formed an 8-member bench under his chairmanship to hear the bill.

According to the text of the reference, the Chief Justice was guilty of misbehavior by presiding over the bench to hear the petitions. The eight judges were found guilty of violating the constitution, law and code of conduct by hearing and suspending the bill of Parliament. The injunction against the Supreme Court Practice and Procedure Bill is a violation of the Dr. Mubasher Hasan case and the Aitzaz Ahsan case.

The reference further states that the 17-member full court in the case of Dr. Mubasher Hasan and the 12-member bench in the case of Aitzaz Ahsan have decided not to issue an injunction against the bill. Hasan and Aitzaz Ahsan case violated. Chief Justice Bandyal violated the code of conduct by protecting his personal, political and interests.

According to the text, Justice Ijaz-ul-Ahsan, Justice Muneeb, Justice Ayesha and Justice Shahid Waheed are likely to become Chief Justices in the future. All four potential future chief justices who joined the eight-member bench were also found guilty of violating the code of conduct. The Chief Justice provided protection to Justice Mazahir Naqvi who was facing corruption charges. By providing protection to Justice Mazahar Naqvi, the Chief Justice violated his oath, constitution and code of conduct.

It has been stated in the text that Justice Ijaz-ul-Ahsan, Justice Muneeb, Justice Mazahir Naqvi illegally involved themselves in the assembly election dispute. A 3-member bench headed by Chief Justice Bandyal refused to accept the majority verdict in the election automatic notice case.

The Chief Justice has been accused of misuse of administrative powers.

According to the text of the reference, Chief Justice Umar Atta Bandial is the main responsible for the formation of all the controversial benches. The Chief Justice was found guilty of violating the Al-Jihad Trust and Malik Asad case by appointing junior judges to the Supreme Court. 8 judges including Chief Justice Bandyal failed to maintain high standards of honest character and were guilty of hearing cases of personal political interest.

The text states that 8 judges of the Supreme Court have been guilty of abuse of power to influence cases and have failed to maintain good relations with other judges and have caused disrepute in the public.

In the reference, it has been requested that the Supreme Judicial Council order the dismissal of 8 judges including Chief Justice Umar Attabandial after an inquiry.

A copy of the reference against the judges has been sent to Justice Qazi Faiz Isa, Justice Sardar Tariq Masood, Justice Mansoor Ali Shah. After the reference against Chief Justice Bandial and Justice Ejaz ul Ahsan, they will be replaced by Justice Mansoor Ali Shah, the next member of the Supreme Judicial Council.

A copy of the reference has also been sent to Chief Justice Sindh High Court and Chief Justice Lahore High Court.
