The Islamabad High Court has granted bail to the Kulfi vendor who was arrested and sentenced by the Magistrate for selling Kulfi outside Faisal Masjid. Why does the law become more difficult in front of the poor?
Justice Tariq Mehmood Jahangiri of Islamabad High Court heard the case filed under the allegation of placing a cart of Qulfis in the parking lot of Faisal Masjid. The court granted bail to Farmanullah, a Qulfi vendor, pending the trial court’s decision. Justice Tariq Mahmood Jahangiri ordered the suspension of the sentence of petitioner Farmanullah pending the decision of the Sessions Court and disposed of the bail application with direction.
Qulfi vendor Farmanullah appeared in the court along with his lawyer Barrister Umar Ejaz Gilani. Justice Tariq Mehmood Jahangiri asked the CDA lawyer that you have done such a great feat, why not reward you for it? The law is being openly violated in the whole city and you found only one Qulfi Wala? Why does the law become more difficult in front of the poor?
Barrister Umar Ijaz Gilani told the court that the CDA officers have made the case an ego issue for themselves which is regrettable. Later, the Islamabad High Court dismissed the bail application of Farmanullah, the seller of Qulfi.
CDA had arrested the Qulfi seller at Faisal Masjid parking lot on charges of encroachment and encroachment, on which the CDA Magistrate sentenced the Qulfi vendor to a fine of Rs 500,000 and three months imprisonment. The Islamabad High Court suspended the sentence and ordered the release of the Qulfi vendor.
