Karachi: The Sindh High Court has reserved its decision on Jamaat-e-Islami’s plea to prevent Mayor Karachi from participating in the by-elections.

A two-member bench headed by Justice Aqeel Ahmad Abbasi heard on Jamaat-e-Islami’s request to prevent Mayor Karachi from participating in the by-elections. Justice Aqeel Ahmad Abbasi inquired whether the mayor is allowed to contest the by-election.

Advocate Jamaat-e-Islami Usman Farooq Advocate stated that the Mayor can participate in the by-election but cannot violate the rules and regulations of the Election Commission.

The court inquired why you did not complain to the Election Commission. The Jamaat-e-Islami lawyer stated that an application was made to the Election Commission, but no action was taken.

The court remarked that whoever participates in the election will also run his campaign, this is a simple matter. Usman Farooq Advocate stated that Mayor Karachi is using government machinery in his campaign, Mayor Karachi Murtaza Wahab is participating in the election from unrelated UCs against the law, UC Chairman must be related to the relevant UC, Murtaza Wahab. Votes not registered in Ibrahim Hydari and Kemari.

The court reserved the decision after hearing the arguments, the decision is likely to be pronounced today.

It should be noted that the stand was adopted in the filed petition that the by-elections should be stopped until the constitutional petition is decided. The participation of Mayor Karachi in the by-elections is a violation of the Code of Conduct of the Election Act. Murtaza Wahab’s participation in the by-election is also a violation of the Code of Conduct of the Local Government Act.

According to the Code of Conduct, any person appointed to a public office can neither participate in the election nor run an election campaign. According to the code of conduct, the mayor, chairman and other officials cannot participate in the election and Murtaza Wahab is participating in the election from three UCs despite being the mayor of Karachi.
