Collector Customs ordered to release containers of imported old auto parts

Islamabad: The High Court ordered the Collector of Customs to release the containers of imported old auto parts.

The court, while ordering the release of the containers detained at Islamabad Dry Port for several months, said that all the containers should be cleared before the budget under prevailing duties, taxes and fines.

According to the court order, the fine should be as per the Finance Amendment Act 2023, which should not exceed 20 thousand and in case of more than 20 thousand, the petitioner should submit a post-dated check to the Deputy Registrar Judicial.

Counsel Adnan Haider Randhawa prosecuted the case on behalf of the 14 petitioners of the Auto Parts Association. Justice Sardar Ejaz Ishaq Khan issued a three-page written order.

The court directed the Federal Secretaries including the Chairman FBR to hold a meeting with the Auto Parts Association while the Secretary Commerce and Secretary Industry Division were also directed to join the meeting.

The Islamabad High Court ordered that the member of Customs Policy should appear in court in personal capacity on the next hearing and inform about the progress of the meeting with the Auto Parts Association before the next hearing. submit If the meeting with the Auto Parts Association does not yield a solution, the court will decide the case.

The court order said that according to the petitioner, the petitioners have been doing auto parts import business for many years. The petitioner said that after import duty, fine and token penalty, the goods are generally released, if the import of auto parts is banned, the repair price will increase and the economy will be impacted.

According to the petitioner, full penalty amendment instead of token will make import trade impossible while the amendment in Finance Act 2023 is being wrongly implemented. The petitioner stated that the amendment was meant to prevent smuggling and not to end import trade. According to the petitioner, the Finance Act amendment cannot be applied retroactively.
