Punjab Governor's reply submitted


Governor Punjab Balighur Rehman has submitted a reply to the petition against not announcing the date of election in the Lahore High Court in which he has said that if the assembly is not dissolved on the advice of the Chief Minister, it is not the responsibility of the governor to announce the date of the election. .

In the Lahore High Court, a hearing was held on the petition of citizen Muneer Ahmed against the non-announcement of the election date in Punjab.

During the hearing, PTI leaders Asad Umar, Shahbaz Gill, Fawad Chaudhry, Sabatin Khan and Aslam Iqbal were present in the court room.

In the reply submitted by Punjab Governor Balighur Rehman, it has been said that when the Governor dissolves the Assembly, it is his constitutional responsibility to give the date of the election, the Governor has not obstructed the authority of the Election Commission.

The Governor of Punjab, requesting to dismiss the petition with penalty, has further stated in his reply that the petitioner is not the affected party, the Governor is performing his duties according to the constitution and law.

Justice Jawad Hasan said in his remarks that we have to follow the logic, first we have to see whether a larger bench is needed or not.

Election Commission’s counsel sought time from the court to submit its reply.

Election Commission’s lawyer told the court that I was appointed as a lawyer yesterday, I have not even seen the orders of the court and have not prepared the answer.

Justice Jawad Hassan said that there are judicial precedents related to conducting the election in 90 days.

The lawyer of the Election Commission said that we have to conduct the election but the date has to be given by the governor, the date of the by-election has to be given by the Election Commission, but the law is different in the authority to give the date of the general election.

Barrister Ali Zafar said that if the Governor and the Election Commission do not give the date, then the President can give the date of the election.

The election commission lawyer said that there are obstacles in its implementation.

Justice Jawad Hasan directed that the Election Commission should tell because I will not tell the governor.

Justice Jawad Hasan directed that Article 105 has to be interpreted.

Barrister Ali Zafar said that it cannot be that no one gives a date, Article 218 says that the Election Commission has to conduct the election, if the Governor does not conduct the election, then the Election Commission must conduct the election under Article 218. The election will be a general election, if the Election Commission also refuses, then the President can give a date.

Justice Jawad Hassan said that the Election Commission did not refuse, while the President is not a party in the case.
