Arrest of chairman PTI from the court is termed as a violation of the fundamental rights of justice

Islamabad: The Supreme Court termed the arrest of PTI Chairman from the cover court as a violation of the fundamental rights to get justice.

In a 22-page written judgment issued by the Supreme Court, it was said that the sanctity and dignity of the courts cannot be compromised, people approach the courts to provide them with a safe environment.

In the written judgment, it was said that the disruption of the judicial environment affects the delivery of justice, the constitution mentions contempt of court in order to secure the access of the people to the delivery of justice in the courts.

Arrest by breaking door, windows and glass of biometric room is against judicial dignity.

In the written decision of the Supreme Court, it was said that in the case of Baz Muhammad Kakar, the Supreme Court has laid down the principle and the delivery of justice cannot be disrupted, the arrest by breaking the door, windows and glass of the biometric room of the High Court is against the dignity of the judiciary.

In the written judgment, it was said that if the lawyers, policemen and high court staff were injured during the arrest, it is tantamount to showing contempt of the court, therefore the Supreme Court declared the law against the arrest of the petitioner on May 11.

In addition, the decision said that the purpose of applying the principles of fundamental rights and transparent trial for achieving justice is to prevent illegal factors in criminal trials. These principles are also applied to bail cases. Right applies.

According to the written judgment of the court, access to justice is a fundamental right, in future the investigating agencies and police authorities should refrain from violating the judicial respect and fundamental rights of citizens.

In the judgment, it was said that Chairman PTI was produced in the Supreme Court at 4.30 pm on the order of the court. Ordered to do so and the court allowed Chairman PTI to appear on the rostrum to give a statement on the unfortunate events of May 9.

The Supreme Court in its written judgment said that Chairman PTI expressed ignorance of the events that took place after his arrest, the court asked if he condemned the events of May 9. He assured and said that the petitioner never incited his followers to violence.

The judgment said that the petitioner Chairman PTI expressed his disappointment on being arrested from the premises of Islamabad High Court, Chairman PTI was allowed to meet the named people at the Police Guest House after police clearance.

The judgment of the three-judge bench also included an additional note by one judge. In the additional note it was said that I agree with the decision from paragraph no. 11 to 24, I will write a separate note containing detailed reasons.

It should be noted that the case was heard by a three-member bench headed by Chief Justice Umar Atta Bandial, Justice Muhammad Ali Mazhar and Justice Athar Manullah were also part of the three-member bench.
