Peshawar High Court has said that how can civilian cases be handled under the Official Secrets Act? This requires an interpretation of the Constitution.
According to Express News, a two-member bench consisting of Justice Ishtiaq Ibrahim and Justice Sahibzada Asadullah heard the petitions filed against the trial of the cases of the suspects arrested in the May 9 and 10 incidents in the military court.
Lawyer petitioner Shah Faisal Atmankhil said that 7 named accused in the incidents of May 9 and 10 have been handed over to the military, the cases of civilians cannot be tried in military courts, after the 23rd amendment, civilians cannot be tried in military courts. .
Justice Ishtiaq Ibrahim said that there is a court martial in the Official Secrets Act, how the cases of civilians can be tried under the Official Secrets Act, there is a need to interpret the Constitution.
Lawyer AAG Daniyal Chamkani said that Army Act is not included in the first FIR, District Public Prosecutor Officer has given his opinion in this regard.
On this, the court said to prepare to hear the case again on June 13. Later, the court adjourned the hearing till June 13.
