Electing non-elected persons as Mayor/Chairman will be against the spirit of Constitution and Local Government Laws, Hafiz Naeem.
Karachi: Amir Jamaat-e-Islami Hafiz Naeemur Rehman has said that People’s Party is using negative tactics. It was said that if PP does not become mayor, then the mayor will not be able to get funds. Is this city someone’s fiefdom?
He expressed these views while talking to the media after filing the petition in the Sindh High Court.
Jamaat-e-Islami challenged the amendment of the Local Government Act to elect unelected persons before the election of the mayor.
Amir Jamaat-e-Islami Hafiz Naeem-ur-Rehman, in a petition filed in the Sindh High Court through Usman Farooq Advocate, took the stand that the local body elections were held under the Primary Local Body Act 2013, under which the elected chairman/mayor candidates took oath. But now under the amendment act, unelected persons have been approved to be made chairman/mayor.
The petition said that according to the spirit of the Local Government Act, the mayor should be among the elected representatives. Articles 90 to 93 and 129 to 131 of the Constitution spell out the structure of the federal and provincial governments. Electing non-elected persons as Mayor/Chairman would be against the spirit of the Constitution and Local Government Acts.
He pleaded that the May 24 notification issued under the recent amendment should be declared illegal.
Hafiz Naeemur Rahman said that he has approached the court on an important issue. With mayoral elections being held on June 15, the Sindh Assembly passed controversial legislation based on its majority, which allows anyone to become chairman or mayor without being a member of the council. Such legislation close to the mayoral election is against the transparency of the democratic system.
Amir Jamaat-e-Islami Karachi said that according to the Local Government Act, it was mandatory for the candidate to be a member of the council. According to the same legislation, we joined the election of council member. A lot of time was lost in the campaigning of the Union Committee. Putting in an outsider is not a level playing field. Eased for a party candidate.
Hafiz Naeem-ur-Rehman said that the legislation was enacted in May and was implemented from December 2021. Legislation of the will of the People’s Party will not be accepted. According to the election rules, there is no obstacle to the success of the candidate of Jamaat-e-Islami.
Hafiz Naeemur Rehman said that where did 8 billion of the development budget in Sindh go? Mr. Zardari has become an economic expert, let him tell where the development budget went. The house officer of KMDC is getting 45 thousand while Sindh Medical officer is getting more money. The system is being operated under a particular videos mindset. It was said that if the People’s Party does not become the mayor, then the mayor will not be able to get funds.
Amir Jamaat-e-Islami further said, “Is this city someone’s domain?” Democracy will not be allowed to be trampled any more. Every negative tactic will be kicked in their face. MRI machines in Abbasi Hospital are broken but funds are being released for advertisement. The problems of municipal atrocities in the city are not discussed. Look at the plight of the city’s hospitals at the hands of those who claim to fix the country’s economy.
