Q-League's request to dismiss the petitions against the Supreme Court Practice and Procedure Act

Islamabad: Pakistan Muslim League-Q requested to dismiss the petitions filed against the Supreme Court Practice and Procedure Act.

In the reply submitted by the Muslim League-Q in the Supreme Court, it has been stated that the Act will not increase or decrease the independence of the judiciary. After the lawyers’ movement in the country, the opportunity for reforms was missed. Section 4 of the Act widens the jurisdiction of the Supreme Court.

The reply further states that Section 3 of the Act does not curtail the exercise of the Judiciary’s 184(3) power. Section 3 calls for indiscriminate exercise of the Chief Justice’s power of automatic notice in conjunction with senior judges. The appointment of cases by the Committee and exercise of the powers of self-notice will increase public confidence.

The position of Pakistan Muslim League-Q has been taken that former Chief Justices Iftikhar Chaudhry, Gulzar Ahmed, Saqib Nisar used their powers actively. The results of exercising the powers of the Chief Justice came out in the case of Steel Mill, PKLI and Nasla Tower. Legislation such as the Practice and Procedure Act could have avoided such consequences. An independent judiciary means the performance of duties of every judge without restriction, pressure and interference.
