In the case of investigation of Tosha Khana gifts, the court issued a major order against the NAB notices sent to Imran Khan and Bushra Bibi, which gave Imran Khan and Bushra Bibi early relief as a result of the recent NAB amendment.
The Islamabad High Court has said that the NAB notices are not in accordance with the law, therefore they have no legal status. NAB can issue a new notice after fulfilling all the requirements of the law.
It should be noted that Imran Khan and Bushra Bibi had challenged the notices sent by NAB on March 16 and February 17, on which Chief Justice Islamabad High Court Aamir Farooq and Justice Babar Sattar issued a detailed 7-page decision. , in which it has been said that according to the NAB amendment, NAB has to state in the notice whether it is summoned as an accused or in any other capacity.
The court said that if there is an accused, he should be told the charges so that he can present his defence. This amendment of NAB shows that it was done to fulfill the requirements of Article 10-A fair trial. While sending notices to Imran Khan and Bushra Bibi, Section 19E of the NAB amendment was not fully implemented. In the NAB call-up notices, it is not mentioned whether he is being called as an accused or in any other capacity. NAB call-up notices are also not compatible with the rules laid down by court decisions.
The Islamabad High Court declared the 2 call-up notices of NAB illegal and declared that NAB can send new notices after fulfilling all the legal requirements.
