The Islamabad High Court has fixed May 5 as the date of hearing for the final arguments on the separate petition to withdraw the petition against the Election Commission’s decision to disqualify Chairman PTI Imran Khan in the Tosha Khana reference.
Imran Khan has filed an application to withdraw the pending case in the Lahore High Court.
The Supreme Court also extended the injunction to stop the by-election in Mianwali till May 5.
During the hearing, the court inquired that when one forum has been referred, can it be referred to another forum while it is pending? Can one withdraw the request from one forum and pursue another in such a case?
Lawyers of Mohsin Shahnawaz Ranjha opposed the withdrawal of Imran Khan’s application.
The petitioner’s counsel has taken the stand that the case was pending in this court, meanwhile the petition was filed in the Lahore High Court.
The petitioner also says that this court was not informed about filing the petition in the Lahore High Court.
