Pemra's demand for surcharge from PBA is against the ordinance, Supreme Court

Islamabad: A three-member bench of the Supreme Court issued a written decision on PEMRA’s petition against the Pakistan Broadcasting Association (PBA).

A three-member bench headed by Justice Mansoor Ali Shah issued a decision on Pemra’s petition against PBA and dismissed Pemra’s petition against the decision of the Sindh High Court.
The written judgment states that there is no authority to levy and collect surcharge on late payment of annual fee under PEMRA Ordinance 2002, demand of surcharge under PEMRA Regulation is against the 2002 Ordinance.
In a written judgment issued by a three-member bench headed by Justice Mansoor Ali Shah, it has been said that PEMRA has no authority to collect such surcharges, and no reasonable reason to interfere in the High Court’s decision was seen.
