Early Elections and Possible Consequences

The work of the judiciary is to protect and enforce the constitution of the country, it sees in cases what the law and the constitution says about it and makes decisions accordingly, it only follows the constitution and the law. Explains.

Our Supreme Court in the suo motu case issued a decision last month that the provincial assembly elections in Punjab and Sindh should be held within the prescribed constitutional period of three months.

Since this decision belongs to the Supreme Court, we will not say anything about it, however, we can talk about the problems that may arise by holding elections a few months before the national elections in two provinces.

Interim governments are established in Punjab and Khyber Pakhtunkhwa according to the constitution. Under these supervisory governments, if the elections are held today and six months later, the elections for the National Assembly and the remaining two provincial assemblies will be held, will the ruling governments in the two provinces not influence these elections?

It cannot be that these new governments are removed for a few days and a neutral interim seat is established.

One aspect is that the constitutional term of the Punjab and Khyber Pakhtunkhwa governments will expire six months before the national elections, Sindh and Balochistan assembly elections every time and such elections will have to be held there every time. This cycle will be endless and Pakistan will forever become a political battle ground which will result in nothing but destruction, these are the aspects that should have been considered.

The Election Commission, while postponing the scheduled Punjab and Khyber Pakhtunkhwa Assembly elections, did not bring this aspect forward in its decision, although it is a very important and deliberative issue.

The Election Commission must have said that the security agencies are not providing security for it to conduct a clean and transparent election and the Ministry of Finance is also not providing the required funds for the election, so it apologizes for conducting this election, although Perhaps it would have been better if the two main reasons mentioned above were also included. Now the matter is once again going before our Supreme Court.

Now the problems have become more complex and complicated. If the elections of Punjab and Khyber Pakhtunkhwa assemblies were to complete the remaining constitutional period of six months, there was no error in this decision, but this election has to be held for the entire period of five years.

In such a situation, the same problem will arise every five years in the two provinces that the first elected provincial governments will try to exert influence in the national elections. There will be transfers and appointments of officers before the elections and no court will be able to stop them.

The losing party in the election will refuse to accept the election results and if it is Khan Sahib himself then you can imagine how violent and massive the protest will be. The country will be plunged into chaotic politics and will never be able to come out of the economic crisis again.

If Islamabad can be jammed by protesting for 126 days, the parliament and the federal government can be stopped from working, the visit of the Chinese prime minister to Pakistan can be canceled, then you can think that the national Assemblies, Sindh and Balochistan Assemblies elections are declared suspicious, rigged and unacceptable, so nothing can be done.

We well remember that when General Zia-ul-Haq suddenly deposed the constitutional government of Prime Minister Muhammad Khan Junejo, the Supreme Court, while deciding, brought this issue to the fore and declared Junejo’s government unconstitutional. But since the general elections are going to be held in the country now, we cannot restore that old assembly.

Judiciary while deciding did not see what the constitution and constitution of the country says. Keeping the situation and ground facts in front, he gave such a decision which was accepted by all. Even now, such a decision would have been given that since the general elections are going to be held soon, it is better to wait for a while.

While hearing the petition against the decision of the Election Commission, the Supreme Court must keep in mind this important aspect and also keep in front of the current financial and economic crisis of the country that the nation cannot waste billions of rupees in repeated elections. Elections that will make the problem worse instead of solving it.

The question is also why the two provincial assemblies were broken? The constitutional term of the Punjab and KP Assemblies had not been completed, there was no danger to the KP government, there was no danger in Punjab either, if the aim was to pave the way for the national elections, then it was better that all the parties would have been forced to hold general elections and some middle ground would have been chosen on which all parties would have agreed and agreed.

In the current situation, if the opposition parties of PTI win by conducting elections, will Khan accept the results? no way. This is not being done out of spite, but it is being done considering Khan Sahib’s politics and his protesting mood.

Khan Sahib has said many times that he has not learned to accept defeat. In 2014, he was not as popular as he is today, but we all still remember the indifference he had.
