Karachi: The Sindh High Court has issued notices to the Election Commission on the request for an urgent hearing against the acceptance of the resignations of the resigned MNAs of Tehreek-e-Insaf Karachi.
A 2-member bench headed by Chief Justice Sindh High Court Justice Ahmed Ali Sheikh heard the petition against acceptance of the resignations of the resigned MNAs of Tehreek-e-Insaf Karachi. The resigned PTI MLAs requested an immediate hearing.
The Chief Justice inquired why you have come here. PTI’s lawyer stated that the by-election is on March 16 and our request should be heard immediately. You have fixed March 21 as the date by which the elections will be held. If the ballot papers are hidden, the people will lose crores of rupees.
The Chief Justice remarked that we will decide after hearing the petition. Why are you creating an emotional atmosphere, we will hear and decide according to the law. The court issued notices to the Election Commission on the request for urgent hearing. The court fixed the hearing of the application for March 7.
In the petition filed, the stand was taken that the members of the National Assembly were wrongly de-notified and legal procedures were not followed. Speaker National Assembly did not complete the process of approval of resignations according to law. The resignations of the resigning members were not confirmed. The Election Commission also de-notified MNAs in the light of this decision. The Election Commission’s notification of acceptance of resignations should be declared illegal and null and void.
Those who filed the petitions include MNA Ali Zaidi, Aftab Jahangir, Faheem Khan, Attaullah Advocate, Saifur Rehman Mehsud, Aftab Siddiqui, Aslam Khan, Najeeb Haroon and Alamgir Khan.
