Announcement of Bar Councils to file references against Supreme Court Judge


Pakistan Bar Council (PBC) and Provincial Bar Councils have announced to file 6 references against the Supreme Court judge over audio leaks.

Vice Chairman PBC Hasan Raza Pasha said in an interview with the media in Islamabad that he expects that the judge will resign from the post after the audio leaks.

He said that in the PBC meeting, all the provincial bar councils, chairman of the Islamabad bar, members of the judicial council were invited and the current situation was discussed.

Hasan Raza Pasha further said that the issue of audio leak was raised in the meeting, the Chief Justice was also demanded to conduct a forensic audit of the audio leaks, but no response was received.

He said that the bar councils would file separate references against the Supreme Court judge over the audio leaks.

The Vice Chairman PBC also asked the government to withdraw the review appeal against Justice Faiz Isa’s reference judgment as the reference was based on bad faith, which was filed for blackmail.

Hassan Raza Pasha said that the draft of protection of lawyers was presented to Prime Minister Shahbaz Sharif in May 2022.

He said that the Lawyers’ Protection Act should be approved by the Parliament, Article 184-3 should be amended and the affected party should be given the right to appeal.

Vice Chairman PBC said that there is a unanimous demand that retired judges and generals should not be re-employed.

He said that references will be filed against the Supreme Court judge under Article 209 next week.

Hasan Raza Pasha said that Sindh, Baluchistan, Peshawar, Lahore, Islamabad, Pakistan Bar Council will file references.

He said that the rules for the appointment of judges in the Supreme Court should be amended, they will not negotiate on the principle of seniority.

Vice Chairman PBC said that a judge who is not fit to be appointed in the Supreme Court is not fit to stay in the High Court.

He said that no judge has been brought to the Supreme Court from Khyber Pakhtunkhwa in 5 years, the senior judge of KP should be appointed to the Supreme Court by calling a meeting of the Judicial Commission next month.
