Karachi: Additional District and Sessions Judge Malir sentenced the accused to 80 lashes under the Qazaf Ordinance 1979 in the case of denying the paternity of the girl child and accusing his wife of adultery.
In Karachi’s Malir Court, Additional District and Sessions Judge Shahnaz pronounced the verdict of the case related to denying the paternity of the girl and accusing the wife of adultery. The court sentenced the accused Farid to 80 lashes.
The court said in the verdict that the accused has been sentenced under Qazaf Ordinance 1979. The testimony of the accused will not be admissible in any court after the confirmation of the sentence by the Federal Sharia Court, under this section the accused is granted bail.
The court ordered the accused to submit a surety bond of Rs. The court said in the verdict that the accused should be present for the execution of the sentence at the time and place fixed by the court.
In the judgment, the court said that during the hearing, the accused did not file any request for pardon, the accused did not even deny the accusations of adultery against his ex-wife. According to the prosecution, the plaintiff was married to the accused in 2015. After staying at the house of the accused for a month, she went back to her house where a daughter was born to the plaintiff.
The plaintiff approached the court for non-payment of alimony. The court pronounced a verdict against the accused. During the trial, 2 applications were filed on behalf of the accused. In the application, there was a request to get the DNA of the girl and to deny paternity.
After some time, the accused withdrew from the applications. The plaintiff then filed an application in the Sessions Court against the accused under the Limitation Ordinance.
