Order to end the encroachments from Al-Asif Square to Toll Plaza and submit a report

Karachi: The Sindh High Court ordered to end the encroachment from Al-Asif Square to Toll Plaza and submit a report.

A two-member bench headed by Justice Nadeem Akhtar heard the petition regarding the end of encroachment from Al-Asif to Toll Plaza.

Justice Nadeem Akhtar inquired as to who has come from the DC office. The Additional Advocate General stated that no one appeared from the DC office. The court inquired that the viewer’s report has been seen by the NHA and SCORE private company has allowed the people. Justice Nadeem Akhtar remarked that according to the viewer’s report, the dumper loader, the construction is unpaved and there is a bus stand, under what authority have you accommodated these people.

The counsel for the private company stated that we had written agreements which were also not being implemented. Justice Nadeem Akhtar remarked that why would people who are earning crores of rupees vacate the place. Officials of the private company said that we have built a double road, stop the encroachment at this place. These people have taken injunctions from the District Courts.

Justice Nadeem Akhtar remarked that the encroachments from 1 to 2 kilometers have ended and all the rest are encroachments. Why has no one come forward from DC East?

The petitioner’s counsel submitted that the private company has established its rule, the private company has issued the NOC for constructing a petrol pump on our service road. The NOC of the petrol pump was presented in the court on behalf of the petitioner, his lawyer stated that the construction work of the petrol pump is going on day and night.

The court inquired as to why the private company is not submitting the master plan. Justice Nadeem Akhtar remarked whether petrol pumps have been allowed or not. NHA’s counsel stated that we have given permission and the ROW site is there, we are not constructing a petrol pump on the service road, it is the Sindh government site.

The court ordered to stop the construction of the petrol pump till the next hearing. During the hearing, the Assistant Commissioner appeared in the Eastern Court. The Assistant Commissioner said that the encroachment from Al-Asif to Jamali Bridge has been ended.

Justice Nadeem Akhtar asked what steps have been taken since January 15 till now. Assistant Commissioner said that give us time and we will submit the report. The court inquired how much encroachment has been completed since January 15. Justice Nadeem Akhtar remarked that you should write now how much encroachment has been completed and how much is left to tell today. Why the flood victims were not evacuated, the Sindh government has given them a permanent place. Why have these flood victims not been sent back?

The Assistant Commissioner said that they are Afghans and they have been given an alternative place. The court remarked that whatever encroachments there are should be removed.

The court ordered that the action against the encroachment should be continued and a report should be submitted by February 12 after ending the encroachment.
