Islamabad: The Supreme Court has issued a notice to former DGISI General (Rtd) Faiz Hameed in the Shaukat Aziz Siddiqui dismissal case.
Former judge Shaukat Aziz Siddiqui’s case was heard in the Supreme Court by a 5-member larger bench headed by the Chief Justice of Pakistan, in which Shaukat Aziz Siddiqui’s lawyer Hamid Khan appeared.
At the beginning of the hearing, the Chief Justice inquired whether Shaukat Aziz Siddiqui’s allegations are true. Shaukat Aziz Siddiqui was fired for a speech based on these allegations. Think and answer whether your allegations are correct. Did the generals you want to side with themselves want to come to power in the 2018 elections? If Shaukat Aziz Siddiqui’s allegations are true, then those generals were trying to become someone’s facilitator. Who was this general facilitating?

Lawyer Hamid Khan said that the allegations made by me are true. The Chief Justice remarked that you have come before us under Article 184 III. Also remember what can happen under original jurisdiction. Was it intended to benefit someone else? You say that by putting pressure on the courts to disqualify someone, the objective was to benefit someone else. It seems from your accusations that the real aim was to get someone else to sit in the prime minister’s chair.
The Chief Justice remarked that your allegations are of a very serious nature. Was it the purpose of keeping a person in jail to win his favorite person? The real question is who got the benefit. The real beneficiary is someone else. You are favoring the facilitators, the real beneficiary is someone else. You have not mentioned the actual beneficiary in the application.
Justice Qazi Faiz Isa said that you accused people back to back. Those accused were facilitating for someone else. By facilitating, someone benefited. By not following the Constitution of Pakistan, they themselves are trapped in this trap. Facilitators have been made a party, so why not made a beneficiary? , on which the lawyer said that there was no such thing in the speech as to who took the benefit.

The Chief Justice remarked that the jurisdiction of the court has already started in the application of Article 184/3. If the military officer is giving advantage to someone, he will also get caught in this trap. Lawyer Hamid Khan said that the army might have wanted to get arbitrary results, to which the Chief Justice said that a candidate is sidelined so that the favored candidate wins. Lawyer Hamid Khan said that this is what has been happening in the country for 70 years, on which Justice Jamal Mandukhel remarked that what has been happening for 70 years should not be resolved.
The Chief Justice inquired whether the army is an independent organization or under someone? Who runs the army?, to which the lawyer said that the army is under the government. The Chief Justice said that the government is not an individual. Tell the person who runs the army. When you come to us, we will follow the constitution. It is not an easy road. The serious allegations made by Shaukat Aziz Siddiqui will also have serious consequences.
The Chief Justice said that the Supreme Court will not be allowed to be used to achieve anyone’s goals. Justice Jamal Khan Mandukhel remarked that an attempt is being made to use our shoulders. The Chief Justice said that we will not favor any one side.
Advocate Bar Counsel Salahuddin said in the court that the former judge named in his written reply, we are making them parties. Shaukat Aziz Siddiqui did not talk about benefiting anyone else including founder PTI. On the presumption we cannot name anyone to benefit anyone, to which the Chief Justice of Pakistan said that this means that Shaukat Aziz Siddiqui’s allegations are also presumptions.
Barrister Salahuddin said that the five persons whose names are being mentioned should be made parties. Justice Jamal Khan Mandukhel said that why was the shoulder of the judiciary used to keep Nawaz Sharif and Maryam Nawaz in jail before the elections? Barrister Salahuddin said that I cannot say at this time that the real purpose of keeping Nawaz Sharif, Maryam Nawaz in jail was to benefit Imran Khan.
The Chief Justice remarked that people should not be harassed by giving notices unnecessarily. Supreme Court will not be used as a shoulder. If you don’t get a proper answer, it will mean you want to use us. Apart from this, Shaukat Siddiqui’s case has remained only to the extent of pension and benefits. We are fixing 10 years old cases for hearing. The formation of judicial benches is being done very transparently.
Barrister Salahuddin said that I do not know that everything was done in hostility to Nawaz Sharif. Justice Jamal Khan Mandukhel said that Shaukat Siddiqui said in the speech, I was told that if Nawaz Sharif and Maryam Nawaz come out of jail, 2 years of hard work will be lost. The question is for what 2 years of hard work was done.
The Chief Justice inquired that if anyone’s name is written down, should he be noticed? Should Shaukat Siddiqui write down the name of Barrister Salahuddin, then notice you too? All this happened to expel which political party? . Barrister Salahuddin Ahmed said that Nawaz Sharif was expelled by putting pressure on the judicial system. The Chief Justice inquired who benefited from this? . Did this happen to benefit Sindh Bar or Islamabad Bar? .
The Vakil Bar Association said that we have requested an inquiry to bring out the facts. The Chief Justice said that if the Sindh Bar sympathizes with Shaukat Siddiqui to get her pension, then it does not come within the purview of 184-3. Don’t tell us to make an inquiry or do it. You support what needs to be done, we will do it. Justice Jamal Mandukhel said that the problem is that the judicial system is accused of using it. Why was our servant used and told that Nawaz Sharif should not come out before the elections?
Lawyer Salahuddin Ahmed said that this allegation is on Faiz Hameed. The Chief Justice asked why the Bar Councils came into this case. The lawyer said that we want to investigate whether the dismissal of Shaukat Siddiqui was really done to benefit the founder PTI. The Chief Justice remarked that we will proceed in a manner. The government will give pension to Shaukat Siddiqui anyway. Shaukat Siddiqui is over 62 years old, he cannot recover.
On this occasion, the Supreme Court summoned the Attorney General. The Chief Justice said that if the problem is only about pension, then ask the government, they will give it to you. If you want to correct the history of Pakistan, then let us know, we are ready to help you. If the goal is only pension, then it will be fine, why should we bother to call anyone?
Justice Jamal Mandukhel said that you say people are used as tools here. Who uses it as a tool? . All that has happened in the past is to be corrected. Lawyer Hamid Khan said that you stopped naming the establishment when this is the reality of this country.
The Chief Justice remarked not to put words in our mouths. This is a constitutional court, use constitutional language here. Our position is clear where political jurisdiction ends and judicial jurisdiction begins. Since when your case has not been fixed, stand up and make this accusation in front of us, we will apologize. When the political party came regarding the date of election, we decided in 12 days. When has the case been decided so quickly in the country? . We ordered the constitutional bodies to fulfill the responsibility of conducting the elections. The problem is that no organization is ready to do its job.
The Chief Justice said that Shaukat Aziz Siddiqui has taken the name of Faiz Hameed. The conversation about Qamar Bajwa has been heard. Qamar Bajwa had not directly spoken to Shaukat Aziz Siddiqui. Justice Jamal Mandukhel inquired whether the Chief Justice of the High Court had made the bench that Faiz Hameed wanted. Lawyer Hamid Khan said that what Faiz Hamid wanted happened. Faiz Hameed wanted Nawaz Sharif not to get bail before election 2018. The Chief Justice said that now you yourself have brought the matter up to Election 2018. Justice Jamal Mandukhel asked what was the decision on Nawaz Sharif’s appeal? , on which the lawyer said that the appeals have just been decided and Nawaz Sharif has been acquitted.
During the hearing, Advocate Hamid Khan read the details of the allegations in the court. The Chief Justice said, “Are you saying that only one individual person was Faiz Hameed who was doing everything?” The rest of your words have been heard. Your sentence is very meaningful that you said Nawaz Sharif and Maryam should not come out of jail before the elections.
Justice Jamal Khan Mandukhel inquired that the bails have been arranged in the case of Nawaz Sharif and Maryam Nawaz. The Chief Justice remarked that we should not discuss it, these cases may come before us tomorrow. You said in the allegations that the Faizabad sit-in was sponsored. The lawyer said that people were putting pressure on Shaukat Aziz Siddiqui based on the impression that the dharna was sponsored.
The Chief Justice said that what kind of decisions the pressurers wanted why they were pressing. We cannot simply follow signs. Lawyer Hamid Khan said that we have placed the names before the court. Now it is not for this court to decide who is to be noticed and who is not. The Chief Justice said that there is no connection with General Bajwa. You say that Faiz Hameed came at the behest of General Bajwa. There is no direct accusation against General Qamar Javed Bajwa. Nowadays people use someone’s name. Ramey is also irrelevant to this case.
Later, the Chief Justice of Pakistan started writing the order for today’s hearing in the Shaukat Aziz Siddiqui dismissal case. The court issued a notice to former DGISI General (Rtd) Faiz Hameed. Apart from this, the Supreme Court also issued notices to former Chief Justice Islamabad High Court Anwar Kasi, Brigadier Irfan Ramey, former Registrar Supreme Court Arbab Arif. The court directed the petitioner Shaukat Siddiqui to file the amendment petition within 7 days.
The court said that 3 persons who were made parties by Shaukat Aziz Siddiqui, are not directly related. No notice was issued to Qamar Javed Bajwa, Tahir Wafai, Faisal Marwat.
The next hearing of the case will be held after the holidays. According to the court order, the amendment petitions should be filed within a week. The Supreme Court Office will issue a notice after receiving the amendment petitions. The next final date of the case will be fixed after the availability of judges.
