Karachi: In the case of illegal charged parking, the Sindh High Court ordered KMC to present the law related to charged parking, collection of parking fee and other details and a comprehensive plan.
According to Express News, a two-member bench headed by Justice Nadeem Akhtar of the Sindh High Court heard the petition related to illegal charged parking. The court asked the KMC officials under which law do you collect parking fee?
KMC’s counsel stated that in the Sindh Local Government Act, KMC is allowed to collect parking fees for road maintenance, KMC is allowed to collect parking fees on 41 roads and service roads.
The court remarked that how to stop unrelated persons from collecting parking fee in the name of KMC? Abroad, machines are installed for parking fee, can KMC collect fee in all areas? Will the court have to tell you what your liability is?
The counsel for KMC took the stand that KMC and DMCs have separate parking lots.
Justice Nadeem Akhtar remarked that the KMC report is contrary to the facts, only paperwork will not solve the problem. The petitioner’s counsel submitted that the details given on the website are also contrary to facts.
Justice Nadeem Akhtar remarked that we were given a list of 43 places and there are 81 sites on the website, there are court decisions regarding parking, why are they not being implemented? How can you collect fees in an area which is not within MC limits? If you cannot repair the roads in these areas, under which law are you charging the fee? We need a detailed answer as to how parking is allowed where it should not be.
Court directed KKMC to end illegal parking. The court adjourned the hearing till December 13, directing the KMEC officials to submit the parking law, collection of parking fee and other details and comprehensive plan.
