Order to stop proceedings of Tosha Khana criminal case against Imran Khan

Islamabad: The Islamabad High Court ordered to stay the Tosha Khana criminal case against PTI Chairman Imran Khan.

A hearing was held on Imran Khan’s plea against the Tosha Khana criminal proceedings being admissible. The Islamabad High Court has issued a stay order on the request of Imran Khan.

Chief Justice Amir Farooq issued orders on the request of Imran Khan and issued notices to other parties including the Election Commission.

The court adjourned the hearing of the Tosha Khana criminal proceedings case till June 8, while notices were issued on all four applications of Imran Khan for June 8.

During the hearing, Imran Khan’s lawyer Khawaja Haris stated that the Election Commission’s complaint is not admissible because no letter has been submitted by the Election Commission to appoint a competent authority. He asked to do it, while the complaint filed without the competent authority cannot be heard. Complaints cannot be sent after the prescribed time.

The Chief Justice remarked what the trial court had said on these objections. Khawaja Haris said that the judge said that we will see it during the evidence. The Election Commission cannot send a complaint for criminal action after 120 days and the objection was raised before the trial court but the trial court said that the matter will be seen at the stage of evidence, we say that no further action can be taken on it. .

Khawaja Haris said that we are objecting to whatever is on record, the matter of criminal proceedings should first go to the Magistrate and then to the Sessions Court. The complaint has to be first filed with the Magistrate and then he has to record the opening statement and send it to the Sessions Court.

It should be noted that the Sessions Court had indicted Imran Khan two days ago while the Sessions Court had summoned the witnesses for May 13.
