Islamabad: President Dr. Arif Alvi imposed a fine on the accused in the harassment case.
According to Express News, the President of the State has charged the accused in a case to discourage unnecessary litigation on flimsy grounds and has asked the accused to pay the air fare, to fly the woman from Karachi to Islamabad for hearing. By making the trip, he was put into more mental and financial difficulties.
According to the case, a female Assistant Sub-Inspector (ASI) of the Airport Security Force (ASF) posted at Sukkur (complainant) was allegedly harassed by the airport manager. Within four months, the accused started abusing her.
Allegations were made that in February 2022, the accused divorced the woman, later pressured her to live together, the accused also threatened to terminate her job as an airport manager, sent indecent WhatsApp messages, the complainant complained to the Federal Ombudsman. The Ombudsman rejected the objections of the accused regarding the jurisdiction of the Ombudsman over the case. The accused filed an appeal against the order of the ombudsman to the President of the State, which was also rejected by the President.
The President has said that the proceedings of the original case are still pending in which the evidence is yet to be recorded to establish the fact of harassment. It needs to be discouraged because it is nothing but a tactic to gain time.
The President said that it is settled that no party is allowed to file an appeal in haste, not only the ombudsman but also the valuable time of the President was wasted. Such a tendency of necessarily inconvenient, unnecessary litigation needs to be discouraged.
In his judgment, Dr. Arif Alvi said that to prevent inordinate delay in disposal of cases it is appropriate to impose penalty on the party filing appeal on faulty grounds, the case cannot be decided without examining the evidence.
While rejecting the appeal of the accused, the President imposed the air travel expenses of the complainant on the accused and said that the Ombudsman should complete the proceedings within ninety days, the accused should ensure the payment of air fare to the complainant.
