Former members of PTI National Assembly reached Peshawar High Court to stop the by-elections

Peshawar: Former members of the National Assembly of Pakistan Tehreek-e-Insaf have filed an application in the Peshawar High Court to stop the by-elections to be held on March 16.

In the petition, the Speaker National Assembly, Secretary National Assembly, Election Commission and Federal Government have been made parties. The said petition was filed by the members of National Assembly of PTI through the mediation of Barrister Gauhar Khan.

It was argued in the petition that the Speaker of the National Assembly accepted the resignation of 35 members without fulfilling the legal points. The members of the National Assembly did not appear before the Speaker to confirm the resignation, but they were accepted. Cannot accept resignation without confirmation of resignation.

It has been said in the petition that the assembly of Punjab and Khyber Pakhtunkhwa was dissolved on January 15 and then the speaker accepted the resignations of 35 and then 42 members, while he himself ruled that resignations will not be accepted without the confirmation of the members. But later they were approved which is an illegal move.

The petitioner wrote that when PTI announced to return to the National Assembly, the Speaker accepted the resignation of 35 members and then the Election Commission de-notified them. The Supreme Court also said during the hearing of the case that PTI Members should go back to Parliament and participate in the democratic process.

On this basis, PTI decided to go back to Parliament and the Speaker accepted the resignation of 35 members on January 17. The speaker found out that PTI wanted advice on the chairmanship of the Public Accounts Committee and the appointment of the NAB chairman, so he accepted the resignation out of fear.

In the petition, it has been requested that the court suspend the process of by-elections to be held on March 16 and issue an order to stop the elections.
