Marrying wife's sister without completing Idda is illegal

The Lahore High Court declared the marriage of the wife’s sister illegal without completing the iddah and rejected the interim bail of the accused.

According to Express News, Lahore High Court Judge Justice Tariq Saleem Sheikh issued an 11-page written decision related to a case.

The decision states that marrying the first wife’s sister before the Idda is completed is equivalent to marrying two sisters at the same time. According to Islamic Sharia, a person cannot marry two half-sisters at the same time. According to Islamic jurisprudence and the decision of the Federal Shariah Court, a woman will remain in a marriage relationship until the end of her period.

The decision states that the jurists are agreed that a person cannot marry the sister of his first wife before the Idah of his first wife is completed. Perhaps, the marriage of the first wife to her sister before the completion of her Idda would be considered illegal and also a punishable offence, such a marriage being equivalent to marrying two sisters at the same time.

It is stated in the judgment that the petitioner Maswar Hussain approached the court for pre-arrest bail. On August 2023, a person named Sabir Ali filed an FIR against his brother-in-law Muswar Hussain. According to the FIR, the brother-in-law married his younger sister without consummating the marriage with his first wife. It is against Sharia to marry two full sisters at the same time.

It has been stated in the written judgment that brother-in-law Muswar Hussain’s position is that he married his second sister 9 days after divorcing his first wife. Relevant certified documents were also not provided.

After hearing the arguments, the court dismissed the interim bail of the accused who married his wife’s sister-in-law without completing the Idda.
