Peshawar High Court's order not to arrest Asad Qaiser

The Peshawar High Court has issued an order not to arrest former Speaker National Assembly Asad Qaiser and former MNA Mujahid Ali Khan and has said that they should not be arrested in the cases registered till date.

A hearing was held in the Peshawar High Court on the petition filed for detailing the cases of the former speaker. The hearing was conducted by a two-member bench consisting of Chief Justice Muhammad Ibrahim Khan and Justice Ishtiaq Ibrahim.

The lawyer for the petitioner, Shirafazl Marwat, advocate, said that Asad Qaiser gets bail in one case and is arrested in another case. No case.

Justice Ishtiaq Ibrahim said that we had raised some questions in this case, the Advocate General will assist us, when an accused is arrested in one case, will he be arrested in all the cases registered against him?

Additional Advocate General Nisar Khan was present in the court to reply.

Justice Ishtiaq said that when these people were in power, you were AAG even then? On this, AAG Nisar Khan acknowledged and said that yes, I was also AAG in this government, then resigned and was reappointed by the caretaker government.

The Chief Justice said that how are you arguing this case? AAG said that you are raising a personal question, the Chief Justice said that I am sitting on this chair, so I have no personal position and neither are you AAG in a personal capacity.

The court summoned the Advocate General and said that the Advocate General should come himself, this is an important case, later Advocate General Aamir Javed appeared. The Chief Justice said that you were called because without you it could not have happened.

Advocate General Amir Javed said that I should be given time to prepare for the questions raised by the court, and the court gave him time to prepare until the next hearing.

Asad Qaiser’s lawyer Sher Afzal Marwat said that there are 11 such decisions that if the accused is arrested in one case, he will be considered arrested in all the cases. In this regard, Sikandar Hayat Shah advocate said that arrest should be prevented in the cases against the petitioner.

Justice Ishtiaq Ibrahim said that they should not be arrested in the cases registered till date.

The Chief Justice said that in this case we will also appoint a judicial assistant, we will hear the advocate general, petitioner lawyers and also hear the judicial assistant in this case.

Later, the court adjourned the hearing till December 12.
