Islamabad: The Supreme Court has declared that it is obligatory to pay the right to dowry on the demand of the wife, that dowry is an Islamic concept which is clarified in the Holy Quran and is also recognized in the law of Pakistan, Section 2 of the Muslim Personal Law, 1962. is related to
Chief Justice of Pakistan Qazi Faiz Isa, after hearing a petition regarding non-payment of dowry, wrote in a three-page written order that payment of dowry must be made whenever the wife demands it.
The husband claimed that the marriage was subsisting and therefore dowry was not payable.A three-judge bench of the apex court headed by Chief Justice Isa cited a 2001 judgment which held that dowry can be demanded even during marriage. And the husband is obliged to pay it.
The court order held that the wife had to file a suit for dowry and non-maintenance and that the husband unnecessarily involved her in litigation, which led to the matter reaching this court after six and a half years. This kind of frivolous litigation is paralyzing the judicial system.
However, Vakil Safai has assured that the dowry will be paid to the wife through a bank check within one month, so if the dowry and the above mentioned expenses are not paid, a compensation of Rs. It can also be included.
