Serious allegations against General (R) Faiz cannot be ignored, Supreme Court orders

Islamabad: The Supreme Court issued a written decision to hear the case against General (Rtd) Faiz Hameed, in which the court said that the allegations are serious and cannot be ignored.

The Supreme Court issued the written decision of the November 8 hearing on Moeez Ahmed’s petition against former DGISI General (retd) Faiz Hameed, in which the court said that the petitioner had accused former ISI official Faiz Hameed. Serious allegations have been made. According to the petitioner, he and his family were abducted to occupy Top City.

The court verdict said that General (Rtd) Faiz Hameed is accused of raiding the petitioner’s office and house. General (Rtd) Faiz Hameed is also accused of stealing the belongings of the petitioner’s house and records of the society. The petitioner’s counsel said that apart from the Supreme Court, there is no relevant forum for the proceedings.

The Supreme Court said that according to the Additional Attorney General, the petitioners can approach the Ministry of Defence. The Supreme Court disposed of the petition against Faiz Hameed for not meeting the criteria of Article 184/3. The court held that the petitioner has other relevant forums including the Ministry of Defence. The Supreme Court disposes of these petitions without going into the merits of the case.

The order said that allegations of a serious nature have been made by the petitioner, which, if proved, would damage the reputation of the armed forces, ISI, Rangers and the federal government. Being serious allegations, they cannot be ignored. The petition filed is of a different nature as compared to Clause 3 of Article 184.

The apex court said in the order that the petitioner has other forums. If the Supreme Court directly invokes Clause 3 of Article 184, the rights of other parties will be affected. The petitioner has concerns that the Ministry of Defense will not act on his request. The petitioner said that those accused held important positions.

According to the order, the Additional Attorney General assured that the complainant’s request will be processed. The Additional Attorney General has no reason to doubt the stand given by the Federal Government. If the applicant approaches the Ministry of Defence, the complaint should be reviewed as per law.

Meanwhile, a 2-page additional note by Justice Athar Minullah on the complaint petition against General (retd) Faiz Hameed is also included in the order, which states that the HR cell has been functioning in the Supreme Court since 2005. . It was stated during the hearing that the human rights cell established in the Supreme Court is not in accordance with the law.

In an additional note, Justice Athar Manullah wrote that the court was told that the orders and actions given by the Chief Justice in the chamber are also not in accordance with any law. Human rights letters issued by the Supreme Court create a false impression of being judicial orders. It was stated that calling the parties to the chamber or meeting room by the Chief Justice is against a transparent trial.
