Pervez Musharraf's appeal set for hearing after four years

Islamabad: The Supreme Court has fixed the appeal of former President Pervez Musharraf for hearing after four years.

A four-member larger bench headed by Chief Justice of Pakistan Qazi Faiz Isa heard the appeal against the decision to dissolve the special court hearing the Pervez Musharraf treason case.

The Supreme Court has issued notices to Pervez Musharraf’s family and the federal government on the appeals against the annulment of the special court.

The court also directed to assign numbers to the appeals of Tawfiq Asif, Pakistan Bar, Sindh High Court Bar and also directed to assign numbers to the Registrar’s Office on the appeal of Hafiz Abdul Rehman Ansari.

The court order said that Musharraf’s lawyer said that the registrar had objected to the appeal and the appeal against the objection was fixed in the chamber of Justice Umar Atta Bandial. After that the case was not decided and Musharraf died.

According to the decree, Pervez Musharraf’s lawyer said that the Constitution of Pakistan also talks about giving the right to appeal. The party did not object.

The order of the Supreme Court said that it is regrettable that despite the order of the judge in the chamber, the appeal has not been decided till date, no accused can be accused due to judicial behavior, it is the constitutional right of a convicted person to file an appeal.

The court ordered that Musharraf’s lawyer should contact his widow, son and daughter while the Supreme Court Office put numbers on Musharraf’s appeal.

According to the decree, the court was told that the decision of the Lahore High Court is illegal and in excess of authority. The lawyers said that the decision of the Lahore High Court is illegal, unconstitutional and in excess of authority. It was not, the Lahore High Court gave a decision which has no precedent in the judicial history of Pakistan. Lawyers should assist the court regarding such unconstitutional process, if Musharraf’s heirs want, they can become parties in the case.

After the order, the court adjourned the hearing of the case till November 21.
