Order to return land occupied by maternal uncle to niece after 34 years

Islamabad: After 34 years, the Supreme Court gave the right to the niece from the maternal uncle, the court ordered the Finance Department DG Khan to provide immediate possession of five square land to Sara Akhtar.

The court also ordered the uncle, Sardar Mansoor, to pay all the litigation expenses to the niece.

Chief Justice Faiz Isa remarked that women’s rights are being violated in an unconstitutional and illegal way, hand over the land to Bhanji.

The petitioner’s lawyer said, “Does the court say that whatever women say will be accepted as correct?”

The Chief Justice remarked that no special concession is being given to women, making the same observation which is unfortunately happening in the society.

The petitioner’s lawyer said that it is not always necessary for a man to violate the right of a woman, on which the Chief Justice said that there has not been any case in which a woman has violated the right of a man. The lawyer said the niece sold her land to uncle Sardar Mansoor in 1989 and claimed ownership of the land 20 years after the sale and denied her own signature.

Justice Aminuddin Khan remarked that it was the buyer’s job to prove the purchase of the land, while Justice Athar Manullah said three courts ruled against the petitioner.

Sara Akhtar’s lawyer Yasin Bhatti appeared in the court. He stated that Sara Akhtar was a minor at the time of the alleged sale of the land and Sara’s uncle Sardar Mansoor is the former chairman of the district council.

A three-member bench headed by Chief Justice Faiz Isa heard the case.
